Richard C. Litwin devotes his practice to state and local tax controversies arising from sales and use tax, local county tax, corporate income tax, personal income tax, state residency and property tax matters. He has been selected as a Georgia Super Lawyer and as one of Georgia Trend Magazine's Legal Elite in Tax, Trusts & Estates. He served as Chairperson of the State Bar of Georgia Section of Taxation (2001-2002) and heads the Education Committee for the section. He has also served as Chairperson of the Atlanta Bar Association Taxation Section. He is a past member of the Georgia Department of Revenue Business Advisory Committee and has worked on projects with the Department of Revenue, in his role as a member of the Georgia Department of Revenue Liaison Committee and as a member of a special task force formed to address State consolidated return filing regulations.

Prior to forming his current firm, Mr. Litwin was a partner at an Atlanta law firm. He was also an Assistant Attorney General in the Tax Section of the Georgia Attorney General's Office, where he represented the Georgia Department of Revenue in state superior, federal and U.S. Bankruptcy Court. Prior to working at the Georgia Attorney General's Office, Mr. Litwin worked in the tax department at the Atlanta office of a Big Six accounting firm. Mr. Litwin speaks frequently on various tax topics, both at national conferences, state bar meetings and state accounting society seminars. Mr. Litwin has also published articles on various aspects of taxation, which have appeared in a variety of recognized publications. He graduated from the University of South Carolina, with a B.S. degree, cum laude, in Economics, and was inducted into Phi Beta Kappa, and he graduated from Emory Law School, where he was a member of the Moot Court Society.

Richard Litwin recently won a case in U.S. Bankruptcy Court in which the Bankruptcy Court refused to abstain (in response to the taxing agency's motion to dismiss) from hearing a complaint to determine discharge of taxes. Prior to bankruptcy, the taxing agency asserted personal liability against the debtor. The debtor did not appeal the agency's assessment because he did not have the funds to pay for a bond to fight the assessment. The debtor filed a Chapter 7 bankruptcy case and, within the case, the debtor filed a complaint to determine dischargeability of the tax liability. The taxing agency moved to dismiss the complaint. The taxing agency argued that Bankruptcy Code § 505(a) affords the Court the right to abstain and that the Court should not hear a tax case. The taxing agency cited the legion of cases that support the dismissal of such a case where the estate has no assets and the ruling will only serve to benefit the debtor and not any creditors of the estate. The Court denied the taxing agency's motion to dismiss, ruling that "permissive abstension" is provided under 28 U.S.C. § 1334(c)(1) and that use of the word "may" in Bankruptcy Code § 505 does not authorize the Court to abstain from hearing a case over which the Court has jurisdiction under 28 U.S.C. § 1334(c)(1). See Haysman v. Georgia Department of Revenue (In re Haysman), 2009 WL 6499211 (Bankr. N.D. Ga. 2009). In denying the taxing agency's motion to dismiss, the Court noted that permissive abstention is allowed under 28 U.S.C. § 1334(c)(1) only where there is an alternative forum to hear the case and that no such forum existed under the facts in the case. The case continued. The parties filed cross-motions for summary judgment on whether the debtor was liable personally for trust taxes owed by a business. The Court granted the debtor's motion for summary judgment and denied the taxing agency's motion for summary judgment, holding that the debtor was not a responsible party. See Haysman v. Georgia Department of Revenue (In re Haysman), 432 B.R. 336 (Bankr. N.D. Ga. 2010).
